Keabsahan pernikahan siri dalam perspektif hukum keluarga islam dan perundangan di indonesia
Abstract
Unregistered marriage, commonly known as siri marriage, is a form of marriage that holds religious validity but lacks official registration with the state. This phenomenon frequently leads to legal complications, especially regarding the rights of women and children born from such unions. This article explores the legitimacy of siri marriage from the perspectives of Islamic family law and Indonesian legal regulations. Utilizing a literature review method, the study finds that although siri marriage is acknowledged in Islam, state law requires official registration as a binding legal administrative procedure. Without this registration, women and children may forfeit their legal rights, including those related to inheritance, alimony, and legal status of the children. Consequently, it is essential to find a solution that harmonizes religious and legal considerations to safeguard the rights of all parties involved. Women and children born from unregistered marriages often face difficulties in obtaining their rights, both in terms of livelihood, inheritance, and legal status. To overcome this problem, a broader understanding is needed regarding the importance of registering marriages in Islam and national law.
