Nilai Konstitusi dalam Konteks Indonesia Saat ini
Abstract
The constitution is a fundamental basis for the establishment and maintenance of a sovereign state. Constitution as the supreme legal norm shows that the constitution regulates not only the structure and mechanism of government but also reflects basic values such as democracy, social justice, popular sovereignty, unity, and human rights. Therefore, this journal discusses the background, definitions, histories, and values contained in the constitution, especially in the context of Indonesia. Through the theory of expert revues and historical studies of amendments to the 1945 Constitution, this paper shows how the Indonesian constitution has evolved from a purely normative document to a means of legitimizing and controlling power. However, the application of constitutional values in Indonesia today still faces several challenges such as the power of law is not supreme, social imbalance, radicalization, and political elites dominate the state. Therefore, the political concsyslkawu ad put option of la, coklecrrves dr conceiusnes of the people, and the courage of the state in imprinting constitutional principles are keys in achieving the constitution’s goals substantively
