Kaidah al-ḍarar yuzal dalam perlindungan hak masyarakat: studi kasus hukum lingkungan di indonesia
Abstract
The principle of al-ḍarar yuzāl, which means "harm must be eliminated", is one of the key concepts in Islamic jurisprudence. It emphasizes that any form of damage or danger that affects society must be prevented or removed. In today's context, this principle is highly relevant to environmental issues, especially when development or natural resource exploitation causes harm to both people and nature. One example is the nickel mining activity in Raja Ampat, which is considered to have damaged protected forest areas and affected the rights of indigenous communities. This study aims to explore the meaning of the al-ḍarar yuzāl principle and how it can be applied to protect community rights within the framework of environmental law in Indonesia. This research uses a normative qualitative approach through literature review. The findings show that this principle aligns with national environmental regulations, especially in the areas of prevention and recovery. It can also serve as a moral and legal foundation for efforts to protect the environment and support justice for affected communities.
