Abstract

This study examines discrimination issues within Indonesia's law enforcement system, revealing fundamental gaps between constitutional principles and field practices. Through a juridical-normative approach reinforced by sociological analysis, this research uncovers systematic discrimination occurring at every stage of legal proceedings, from investigation to verdict execution. Findings indicate that socio-economic status, political power, and financial capacity serve as primary determinants in legal processes and outcomes. The striking disparity in sentencing between corruption cases involving trillions in state losses and minor criminal cases affecting lower-class communities reflects a double standard within the judicial system. Unequal access to legal aid, weak integrity among law enforcement officers, power intervention, and low legal awareness among society constitute mutually reinforcing root problems. The impacts extend beyond eroding public trust in judicial institutions to widening social gaps and threatening national stability. Addressing these issues requires comprehensive reform encompassing strengthened judicial independence, system digitalization for enhanced transparency, equitable expansion of legal aid access, and continuous capacity and integrity improvement among law enforcement officers.
