Penyalahgunaan kewenangan dalam hukum administrasi negara: pemberian izin usaha pertambangan dan upaya penegakan prinsip good governance
Abstract
Abuse of authority in state administrative law is a crucial issue that threatens the integrity of governance, especially in granting mining business licenses. This research analyzes legal problems due to abuse of authority, which include weak supervision, regulatory inconsistencies, and low accountability of public officials. Using the literature study method, this research discusses the application of good governance principles to prevent the adverse effects of abuse of authority, such as state losses, violations of community rights, and environmental damage. Prevention strategies include strengthening regulations, transparency through digital technology, and supervision of internal and external institutions. Meanwhile, legal handling is carried out through cross-agency coordination, strengthening the role of the State Administrative Court, and enforcing criminal law against corrupt acts. The implementation of good governance principles such as transparency, public participation, and the rule of law are key steps to improve governance and increase public trust. This research provides strategic recommendations to create a more accountable, responsive, and sustainable public administration.
