Kesenjangan antara norma dan implementasi
Analisis penegakan Hak Asasi Manusia di Indonesia
Abstract
Human rights are fundamental rights inherent to every individual from birth and cannot be revoked under any circumstances. The enforcement of human rights serves as a crucial indicator in assessing the quality of democracy, justice, and the rule of law in a country. This study aims to analyze the gap between legal norms and the implementation of human rights enforcement in Indonesia, as well as to identify key challenges and strengthening strategies in the modern era. The method used is a qualitative literature review based on various academic sources, particularly from the UIN Maulana Malik Ibrahim Malang repository. The findings indicate that although Indonesia has relatively adequate legal frameworks, the implementation of human rights enforcement still faces significant challenges, such as weak law enforcement, low public awareness, and conflicts of interest that affect legal objectivity and consistency. Furthermore, the rapid development of digital technology has introduced new challenges in human rights protection, especially concerning privacy and data security. Therefore, a multidimensional approach is required, including strengthening legal institutions, improving public awareness, and fostering collaboration among government, academia, and civil society to achieve a more effective, transparent, and just human rights enforcement system.
