Breach of contract in land lease agreements often results in conflicts when one party does not meet the obligations outlined in the contract. Such scenarios arise from carelessness, deliberate actions, or deficiencies in the agreement's wording, which lead to various interpretations. This article intends to examine the types of contract breaches and their legal implications within land lease arrangements by referencing applicable laws and the viewpoint of Islamic economic jurisprudence. The study employs a normative legal methodology with a descriptive approach, relying on legislation as its primary data source. Findings from the research indicate that a breach of contract necessitates responsibilities for damages, cancellation of the contract, and risk transfer as per Articles 1238 and 1243 of the Civil Code. In contrast, under Islamic law, this is regarded as a breach of the ijarah contract that must be addressed justly, avoiding any form of injustice. Furthermore, the process includes landlords, tenants, notaries/PPAT, district courts, and alternative dispute resolution bodies to ensure legal clarity and safeguard rights. This highlights the necessity of having clear, valid written contracts to avert conflicts and maintain an equilibrium of rights and responsibilities within land leasing activities.Downloads
