Abstract

This paper discusses the fundamental values of fiqh siyasah dusturiyah in the Islamic perspective, particularly concerning the principles of siyasah syari’ah, Islamic political democracy, and the concept of tolerance in state life. This study aims to understand how the principles of Islamic governance can be applied in modern political life. The method used in this research is a literature study by analyzing various relevant journals and scientific references related to fiqh siyasah and Islamic democracy. The discussion shows that siyasah syari’ah considers power as a trust that must be exercised based on the values of justice, public benefit (maslahah), legality, morality, and deliberation (shura). In the perspective of democracy, there are differences of opinion among scholars regarding its compatibility with Islam. Some reject democracy because it is considered to place sovereignty in human hands, while others accept democracy as long as it remains within the framework of Islamic law and upholds the principles of consultation and public welfare. In addition, tolerance in fiqh siyasah serves as an important foundation for creating harmonious political life within a pluralistic society. The practice of tolerance was exemplified through the Constitution of Medina during the time of Prophet Muhammad SAW. Therefore, the values of fiqh siyasah remain highly relevant in establishing a just, democratic, and welfare-oriented system of governance.
