The constitution holds a central position in Indonesia's state system as the highest law governing national and state life. This study discusses the role of the constitution, particularly the 1945 Constitution of the Republic of Indonesia, in guaranteeing human rights (HR) in Indonesia. This study analyzes how the constitution functions as a fundamental basis for the protection of human rights. Human rights are guaranteed in the 1945 Constitution of the Republic of Indonesia in Chapter XA, Articles 28A-28J, which include civil and political rights, as well as economic, social, and cultural rights. To implement human rights, an authorized institution is required to enforce the constitution; in Indonesia, this institution is the Constitutional Court (CC). The Constitutional Court acts as a protector of the constitution and also human rights because the Constitutional Court safeguards the rights of citizens and state policies.
