Konsep naskh-mansukh dalam al-qur’an dan relevansinya terhadap dinamika hukum di indonesia

The concept of naskh-mansukh in the Qur’an is an important subject in ushul al-fiqh that discusses the replacement or abrogation of a particular Islamic legal ruling by another ruling revealed afterward. This study aims to analyze the concept of naskh-mansukh and its relevance to the dynamics of law in Indonesia. The research employs a qualitative method with a library research approach by examining literature related to ushul al-fiqh, Islamic law, and Indonesian national law. The findings indicate that naskh-mansukh reflects a gradual process of legal change that considers social conditions and the readiness of society to accept legal provisions. This concept does not signify contradictions within the Qur’an; rather, it serves as a mechanism for legal refinement aimed at achieving public welfare (maslahah). Its relevance to the Indonesian legal system can be observed in the amendment and reform of legislation in response to social, economic, political, and technological developments. Legal reforms, such as the Job Creation Law and the new Criminal Code, demonstrate similarities with the principle of lex posterior derogat legi priori. Furthermore, the dynamics of Islamic law in Indonesia are reflected in the development of fatwas, ijtihad, and Islamic economic regulations that continue to adapt to the needs of modern society.
