Kodifikasi dan unifikasi hukum islam

The format of Islmaic law as we know it today is the result of a systematic process of unification and codification that has been ongoing since the time of the Companions (sahabah) through the era of Imam al-Shafi’i. This paper aims to examine the historical synamics of the ormation of this law, the vital role of the Principles of Islamic law (Usuliyah) and the Principles of Islamic jurisprudence (Fiqhiyyah) as instruments for the exploration of evidence, and its impact on Islamic civilization. This study finds that the standardization of rules by the four main schools of thought (mazhab) in the past successfully created legal product actually triggered a false sense of saticfaction that gave rise to an intellectual stagnation in the medieval period, where academic activicty revolved solely around writing annotations (syarah) and the emergence of the myth of the end of the era of ijtihad. This tagnation was only broken after modern thinkers revitalized the reasoning of ijtihad to address contemporary issues. In Indonesia, this spirit of unifocation of Islamic law was formally adapted into the national legal system to ensure legal perotection for the community, which is manifested, among other things, through regulation on marriage and religious courts.
