Tinjauan hukum ekonomi syariah terhadap persaingan usaha pada marketplace digital di Indonesia

The rapid expansion of digital marketplaces in Indonesia has intensified competition within the digital economy. Platforms such as Shopee, Tokopedia, and TikTok Shop employ strategies including discounts, cashback, free shipping, and flash sales to attract consumers and increase market share. While these practices stimulate economic growth, foster service innovation, and broaden market access for micro, small, and medium enterprises (MSMEs), they also pose risks. Unhealthy competition may arise in the form of predatory pricing, market dominance, and algorithmic manipulation, potentially harming smaller businesses and consumers. This study aims to analyze competitive practices in digital marketplaces and assess their compliance with the principles of Islamic economic law. Using a normative juridical method with statutory and conceptual approaches, the research draws upon legislation, scholarly works, and Islamic legal literature. The findings indicate that competition in digital marketplaces is permissible under Islamic economic law, provided it is conducted honestly, fairly, and transparently, without elements of gharar (uncertainty), tadlis (fraud), or monopolistic practices detrimental to others. Effective regulatory oversight and adherence to Islamic business ethics are therefore essential to ensure a healthy, just, and sustainable digital trade ecosystem.
