Harmoni atau Konflik? Perbandingan prinsip syariah dan hak asasi manusia terhadap UU Tindak Pidana Kekerasan Seksual

This study aims to analyze the harmonization and potential conflicts between Islamic Sharia principles and Human Rights regarding Law Number 12 of 2022 on the Crime of Sexual Violence (UU TPKS). The method employed is normative legal research utilizing statutory, conceptual, and comparative approaches. Data were gathered through a literature review of regulations, Islamic legal literature, human rights instruments, and relevant prior studies.The results indicate that the UU TPKS generally aligns with Islamic Sharia principles, particularly in safeguarding human honor (hifz al-‘ird), protecting life (hifz al-nafs), and promoting public interest. From a human rights perspective, this law comports with the principles of human dignity protection, access to justice, non-discrimination, and victim recovery as mandated by the 1945 Constitution, the UDHR, and CEDAW. However, this study identifies several provisions that could potentially trigger normative and constitutional issues. These crucial points involve the restitution mechanism, testimonies from the defendant's family, and corporate criminal liability. These provisions risk creating tension between victim protection, legal certainty, and the right to a fair trial. Consequently, regulatory refinement and strengthened implementation are essential to achieve substantive justice aligned with both Islamic Sharia and human rights values
