Abstract

A prenuptial agreement is a contractual agreement that contains an agreement between the two parties with binding rules for someone who wants to get married. This agreement regulates the agreement between husband and wife regarding inherited and acquired assets during marriage. This study aims to provide an understanding that commitment in a prenuptial agreement is one of the safeguards to minimize the occurrence of divorce, through the basis for establishing written commitments in prenuptial agreements and prenuptial agreements as an effort to protect women. In addition, the purpose of this research is to maintain the rights and obligations between husband and wife as well as protect and minimize cases that will arise if there is a divorce between the two parties. In its analysis, this study uses the Normative Juridical method which focuses on library research in the form of theories and concepts of thought and ideas by describing them in narrative form. So that this research resulted in a new finding that can be used to develop knowledge in the field of civil law.
