Abstract

Indonesia is a democratic country based on law (constitutional democratic state), with the understanding that the constitution has the position as the highest law, therefore all state administration must be based on the Constitution. The Constitutional Court exists as a guardian of the constitution to realize the ideals of Indonesia as a democratic country based on law. The applicability of jurisprudence as a recognized source of law in Indonesia is always interesting for research. Indonesia, which is influenced by the civil law legal system, basically does not bind itself to jurisprudence. However, if there is a decision that is considered to be a contradiction with the previous decision, it becomes a debate about how the existing jurisprudence applies.
