Abstract

Zawwajul urfi or in Indonesian known as Urfi Marriage is a marriage that meets the requirements and
pillars of marriage, only it is not registered with the marriage registration agency or the Office of Religious
Affairs. Some people equate urfi marriage with sirri marriage, even though there are differences between
the two. The difference is that a sirri marriage is carried out without informing the guardian of the
marriage. Meanwhile, the similarity is that there is no registration at the Religious Affairs Office. It is called
urfi in Arabic which means culture, because marriage without registration has been a culture since the
time of the Prophet. The issue of urfi marriage is an issue that has never been discussed by Salaf scholars,
so it is the task of Khalaf scholars or contemporary scholars to discuss it further and try to find the law.
This research is qualitative research using the Library Research method or literature study from related
journals and articles. Using data and information searches through journal and article publication media
such as Google and Google Scholar via Publish or Perish. The aim of this research is to provide an
understanding of the important role of the presence of guardians and marriage witnesses in the
perspective of Islamic law and positive law in Indonesia. The results of this research show that there are
differences in the Hanafi Madzhab regarding the presence of marriage guardians and differences in the important roles related to marriage witnesses in the Maliki Madzhab. It was also mentioned regarding
laws in Indonesian positive law regarding marriages carried out without registration at an institution
determined by the government.
