Peran hukum Islam dalam pembentukan sistem hukum di Indonesia dengan sejarah, kontroversi, dan implikasinya
Abstract
Indonesia, as a country with the largest Muslim population in the world, has experienced significant influence from Islamic law in the formation of its legal system. The long history of Islam in Indonesia, since the arrival of this religion in the 13th century, has provided a strong foundation for the development and implementation of Islamic law in the national legal system. This article aims to explain the role of Islamic law in the formation of the legal system in Indonesia by analyzing its history, controversy and implications. First, this article traces the historical roots of Islamic law in Indonesia and describes how Islamic values gradually became an integral part of the country's legal system. The colonial and post-colonial periods also had a significant influence in the transformation of Islamic law in Indonesia. Second, this article discusses the controversy that has arisen regarding the role of Islamic law in the Indonesian legal system. Various views and approaches to the implementation of Islamic law have become a topic of hot debate among academics, human rights activists and other community groups. This article covers some of the controversies that have arisen, such as the implementation of Islamic law in areas that implement sharia and issues of gender justice. Finally, this article highlights the implications of the role of Islamic law in the legal system in Indonesia. Islamic law influences various aspects of Indonesian society, including family law, inheritance law, and criminal law. The implications can be seen in the legislative process, public policy and general implementation of law.
