Pentingnya responsivitas hakim terhadap aspek-aspek keadilan gender dalam konteks izin poligami
Abstract
Polygamy is one of the problems that is still being discussed among society. The judge's responsiveness is very necessary in considering and deciding cases regarding polygamy permits. So that no party will feel unfair and unequal. Because everything has been taken into account so that benefit is the goal. The impact of polygamy permits on the rights of women (first wives) can result in the first wife always feeling guilty, because she is deemed unable to fulfill her husband's needs; has an impact on the family's economy and has an impact on safety and health. The difference between judges who have a gender perspective and those who do not is that judges do not only refer to statutory law, but also look at the benefits obtained. Judges who do not have a gender perspective will only look at actual facts and legal aspects without focusing on aspects of gender justice. The research method used is normative with a literature study approach.
