Penyelenggaraan Tarif Parkir Minimarket Perspektif Peraturan Bupati Bangkalan Nomor 09 Tahun 2021 Dan Al-Maṣlaḥah

Abstract

This research aims to determine the implementation of parking rates at minimarkets around the Trunojoyo Madura University campus in improving the welfare and benefits of the community in terms of economic, social, security, environmental and legal benefits in accordance with Bangkalan regent's regulations number 09 of 2021 and al-maṣlaḥah . This research is in the form of field research, the researcher uses a normative juridical approach, with primary and secondary data sources used as data sources. Data collection methods used were interviews, observation and several book, journal and other quotations. The results of this research conclude that there are still parking attendants at minimarkets around the Trunojoyo Madura University campus who still charge parking fees from minimarket consumers which is not in accordance with regent's regulation number 09 of 2021 as in article 16 which prohibits parking attendants from collecting in any form. to subscription parking users who have been determined by the Bangkalan Regency Government. So in the theory of al-maṣlaḥah, according to researchers, this is included in the level of al-maṣlaḥah mulghah, namely benefits that are rejected because they conflict with sharia law. In the case of the parking attendant, he has violated the regulations set by the Bangkalan district government, namely taking or seeking sustenance which is not in accordance with Islamic religious teachings and applicable regulations.
