Kesadaran Hukum Pemilik Kafe Terhadap Kewajiban Pembayaran Royalti Lagu Dalam Live Performance (Studi Pada Kafe Di Sentra Kafe Sudimoro Kota Malang)

Abstract

Peraturan Pemerintah Nomor 56 Tahun 2021 tentang Pengelolaan Royalti Hak Cipta Lagu dan/atau Musik menyatakan bahwa penggunaan lagu secara komersial dalam konteks layanan publik, seperti di kafe, harus disertai dengan pembayaran royalti kepada pencipta melalui LMKN. Tujuan penelitian ini untuk mengetahui bagaimana kesadaran hukum pemilik kafe yang menyediakan live performance musik terhadap kewajiban pembayaran royalti atas hak cipta lagu dan kewajiban pembayaran royalti dalam live performance musik perspektif maqashid syariah. Penelitian ini merupakan penelitian yuridis empiris menggunakan pendekatan yuridis sosiologis. Lokasi penelitian ini di sentra kafe Sudimoro Kecamatan Lowokwaru Kota Malang. Hasil penelitian menunjukkan bahwa, pertama kesadaran hukum yang dimiliki oleh pemilik kafe di Sentra Kafe Sudimoro tergolong rendah. Kedua, dari prespektif maqashid syariah, ketika pemilik kafe tidak melaksanakan pembayaran royalti hak cipta musik, hal ini menunjukkan bahwa pemilik kafe tidak memenuhi atas hak – hak Pencipta, Pemegang Hak Cipta, dan Pemilik Hak terkait. Dengan demikian, tidak terciptanya pemeliharaan terhadap harta (Hifdz al – Mal) dengan baik.

Government Regulation No. 56 of 2021 concerning the Management of Royalties for Copyright of Songs and/or Music states that commercial use of songs in the context of public services, such as in cafes, must be accompanied by royalty payments to creators through the LMKN. The purpose of this research is to find out how the legal awareness of cafe owners who provide live performance music towards the obligation to pay royalties on song copyrights and the obligation to pay royalties in live performance music from the maqashid sharia perspective. This research is empirical juridical research using a sociological juridical approach. The location of this research is in the Sudimoro cafe center, Lowokwaru District, Malang City. The results showed that, first, the legal awareness possessed by cafe owners in Sudimoro Cafe Center was low. Second, from the perspective of maqashid sharia, when the cafe owner does not carry out the payment of music copyright royalties, this shows that the cafe owner does not fulfill the rights of the Creator, Copyright Holder, and related Rights Owners. Thus, the maintenance of property (Hifdz al - Mal) is not well created.
