Abstract

Sexual violence in educational institutions has become a serious issue that threatens the safety, dignity, and rights of students. This study aims to analyze legal protection for victims of sexual violence from the perspectives of Indonesian positive law and Islamic law, as well as to examine prevention efforts in universities and Islamic boarding schools. The research employs a normative legal method using statutory and conceptual approaches through literature study. The results indicate that Indonesian positive law provides protection through the Child Protection Law, the Law on Sexual Violence Crimes, and other supporting regulations emphasizing victims’ rights protection, rehabilitation, restitution, and legal assistance throughout the judicial process. Meanwhile, Islamic law through the concept of maqashid al-shariah emphasizes the protection of life, honor, and lineage as the primary objectives of Islamic teachings, making sexual violence an act that contradicts religious and moral values. Prevention efforts are carried out through education, supervision, strict regulations, strengthening moral and religious values, and creating educational environments that are safe and free from sexual violence.
