The Supreme Court Regulation (PERMA) is a regulatory instrument established by the Supreme Court to support the effectiveness of the administration of justice in Indonesia. PERMA serves to fill legal gaps, clarify technical provisions of the judiciary, and support the realization of the principles of simple, fast, and low-cost justice. However, the development of PERMA has given rise to debate when its substance is considered no longer limited to technical and administrative aspects, but also contains new legal norms of a general nature. This study aims to analyze the position of PERMA in the legal regulatory system, the authority of the Supreme Court in establishing PERMA viewed from the perspective of constitutional law, and the problems of PERMA that contain new norms. This study uses a normative legal research method with a statutory and conceptual approach. The results show that PERMA is recognized under Article 8 of Law Number 12 of 2011 even though it is not included in the main hierarchy of laws and regulations. The Supreme Court's authority to establish PERMA is a form of constitutional necessity, but must still be limited by the principles of legality, separation of powers, judicial restraint, and checks and balances to prevent the expansion of judicial functions into the realm of legislation.
