Prosedur peralihan hak milik atas tanah yang belum bersertifikat serta permasalahannya
Studi di Desa Sukoanyar Kecamatan Pakis Kabupaten Malang
Abstract
Transfer of ownership rights to land is a legal act, one of which is through a sale and purchase transaction. Land registration is very important with the aim of ensuring legal certainty in the future. Likewise, the role of the Village Government in the process of transferring ownership rights to land, especially land that has not been certified, but in the transition activity is very vulnerable to problems or obstacles in the transition process. The focus of the author's study is limited to one of the villages in Malang Regency, namely Sukoanyar Village, District, therefore the author is interested in conducting research entitled Procedures for transferring ownership rights to uncertified land and its problems (Study in Sukoanyar Village, District, Malang Regency). The research method used is empirical juridical research with a qualitative approach. The results showed that some communities still use the role of the Village Head in the process of transferring ownership rights to land, especially land that has not been certified. In the implementation of land transfer in Sukoanyar Village, several obstacles were encountered, including the habit of people who are reluctant to write their land and the low understanding of the community about the types of land rights transfer. Facing these problems, the village will certainly provide solutions in the form of providing counseling to the community about the importance of issuing land documents.
