Abstract

Death is an event that causes legal consequences, both rights and obligations. Regarding the matter of a mandatory will. One of the main points of discussion regarding the obligatory will is within the scope of the object of the obligatory will of different religions. In Indonesia, there are several aspects that regulate this problem. the first is from the Civil Code, for non-Muslims living in Indonesia, then the Compilation of Islamic Law, for Muslims living in Indonesia. This study uses the library research method, which examines documentary data related to the controversies of mandatory wills, then analyzes them to draw conclusions so that they are relevant as a research basis. The purpose of this article is to provide an overview of how Islam views wills as an obligation for heirs of different religions, taking into account the benefits that exist in the current era, religious moderation is a pillar of unity, where problems are related to different wills. religion will be the subject of discussion and study in the discussion of this article. The results of the study show that there is an overlap between the arguments of syara' law regarding the terms of a will in different religious contexts
