Tinjauan maqashid syari’ah dan HAM terhadap kasus Pembantaian massal dukun santet tahun 1998
Abstract
It started with collecting data from the district head at the request of the police regarding people suspected of witchcraft. Then, unexpectedly, the radiogram, which contained data on suspected witchcraft, was actually leaked and reached a group of irresponsible people. Then there was the massacre of witch doctors until September 1998. This case is included in the category of gross human rights violations because it arbitrarily killed hundreds of people. Even though it is categorized as a gross human rights violation, even after the incident has passed for so long, until now, it is not certain what the motive is and who is the main mastermind behind this bloody tragedy. This makes the victim's family unable to feel satisfied with the government's efforts to resolve this case thoroughly. Even now, the victims are still haunted by past traumas, so they are reluctant to tell stories because they are afraid that they will be considered part of the witchcraft in the eyes of society. In terms of maqashid, syari'ah is also in line with human rights, namely the failure to realize protection of the soul as a goal of sharia.
