Abstract

The study of Tarikh Tasyri', or the history of Islamic legal legislation, plays a crucial role in understanding the dynamics of the development of Islamic law from the time of the Prophethood to its spread to various regions, including Indonesia. In Indonesia, the introduction of Islamic law occurred not only through the expansion of power but also through cultural preaching, trade, and peaceful social approaches. This enabled Islamic values ​​to blend into the social structure of a multicultural and religiously pluralistic society. This article examines how Islamic law was accepted, adapted, and implemented in Indonesian society, which possesses a diversity of cultures, languages, and beliefs. In a society that is not religiously homogeneous, Islamic law maintains its relevance through mechanisms of assimilation with customary norms and state regulations. Furthermore, the formation of Islamic law in Indonesia cannot be separated from the influence of colonialism, the struggle for independence, and the subsequent transformation of the national legal system. This article uses a historical-sociological approach to examine how Islamic law has survived and developed amidst plurality, without losing its essence. The author highlights that the flexibility of Islamic law, both in terms of substance and application, is a key factor in its sustainability in a diverse society.
