Tinjauan fiqih muamalah terhadap penerapan prinsip kerjasama dalam dunia bisnis modern
Abstract
This article discusses the principles of cooperation in Islamic jurisprudence (Fiqh Muamalah) and their relationship to modern business practices through a literature review that examines the concepts of syirkah, mudharabah, and various collaborative contracts in Islam. It is evident that cooperation according to Sharia requires justice, willingness, trustworthiness, honesty, and transparency so that each party receives equal rights. Various forms of contemporary collaboration, such as joint ventures, franchises, partnerships, and startup partnerships, align with the concept of syirkah because they combine resources to achieve mutual benefit. However, in practice, contracts often lack clarity, unequal profit sharing, and a lack of transparency, thus failing to fully comply with Sharia principles. This study confirms that modern cooperation models are acceptable as long as they fulfill clear contracts, ensure fair profit sharing, and are free from usury and gharar. The principles of maqasid sharia provide direction for business development while maintaining the benefit and justice. It demonstrates the importance of fiqh literacy for business actors to appropriately apply Sharia values in various forms of contemporary partnerships.
